1.The online auction is organized by the company Balsan Enchères – area of activity of the Coutier – 72400 Cherré-au ( N approval 002-2012)

2.Participation in this auction, implies that the sales conditions are explicitly acknowledged and accepted without reservation.

3.Public auctions are, in accordance with the law, carried out by the Auctioneer, responsible for the OVV BALSAN AUCTIONS. These general conditions of sale are applicable in all their provisions as long as they are not contrary to those stated before the sale and recorded in the minutes. The liability of the OVV BALSAN ENCHERES cannot be sought neither by the seller nor by the buyer.

6. Offers and payments are made in EURO. The auction takes place according to the following auction steps: from 1 € and more : €50

7. The website will indicate an indicative closing time of the auction per specific lot. If, however, a bid is made in the last minute before the closing time of a lot, the auction time for that specific lot will automatically be extended by 3 minutes. Therefore, the extended time will become the new indicative closing time.

8. In addition to the hammer price, the buyer will have to pay the seller a percentage of 10 % (without tax) of the hammer price as auction fees. The OVV BALSAN AUCTIONEERS will give the buyer an auction slip, where the amount of which must be paid promptly on the account of the OVV BALSAN AUCTIONEERS, and in any case before the delivery of the straws to the buyer.

The purchaser is liable for €100 (excl. VAT) for the management of stud cards (on request only), including the Declaration of Birth the following year.

He is also liable for the cost of storage and delivery of the doses from Eurogen to his own implantation center (delivery may be grouped with other straws from Eurogen).

In the case of export to Europe, sanitary costs and transport between Eurogen and the implantation center are also at the purchaser's expense. Prices are specific to each country and location. Rates are expressed net, no live foal fee will be due.

9. During the sale, a lot is sold to the highest bidder. The settlement of the sales price by the buyer is calculated as follows: the hammer price + 10% of the hammer price as buyer’s fee = net price without tax (VAT 5.5%).

The bidder undertakes to pay amount as soon as the auction is closed.

12. Ownership of the straws is transferred to the buyer at the time of award but valid for shipment after payment only, including technical fees for the storage and shipping fees for the straws, as stipulated on each lot when it is put up for sale.

13. The OVV BALSAN ENCHERES expressly reserves the right to arrange, on the same day or within the legal time limit following the auction concerning the last registered number, the resale of a covering or straw of which the buyer would prove to be defective or incapable. Likewise, when the buyer is considered by the OVV BALSAN ENCHERES as not having sufficient guarantees, the OVV BALSAN ENCHERES will be authorized in case of default of cash payment, to put the covering or straw up for sale as “mad  auction “ on the day of, or within the legal time limit, following the auction concerning the last registered number, without formal notice or formality of justice, at the risks and perils of the auctioneer who, due to his “mad “ auction alone, undertakes his financial responsibility to the seller for the costs of the first sale as well as the sale at “mad  auction”.

In any case, the OVV BALSAN ENCHERES will only be liable for payment to the seller of the amount of the resale on the "mad auction". In the event of resale on the "mad auction", unless otherwise instructed by the seller, given to the Auctioneer before the sale, the reserve price indicated by the seller in advance will remain valid. Likewise, and under the same conditions, if immediately after the auction, the bidder is not found to sign his purchase order, the covering and the straw will be represented at auction during the same holiday or the next day. In this case, the liability of the OVV BALSAN ENCHERES can under no circumstances be sought either by the seller or by the unsuccessful bidder.

15. All public auctions are deemed to be cash settled. Payment must be made in cash and immediately after each sale, in euros by bank transfer with ID. No direct cheque or from foreign banks will be accepted. All payments must be made through the OVV BALSAN ENCHERES. Payment will include the hammer price.

16. In case of exportation of the straw, the buyer will have to submit valid transportations documents, within the 3 months following the sale, under penalty of confiscation of a penal amount of the VAT.

17. The present sales conditions are governed by the French law. The consumer may in his own choice, in addition to one of the courts with jurisdiction under the Code of Civil Procedure, invoke the jurisdiction of the place where he resided at the time of the conclusion of the contract or the occurrence of the harmful event.

The present sales conditions are written in French. They are applicable and have effect only in the original language of the text.

Any translation into a foreign language of these conditions of sale is provided for indicative purposes only and cannot legally bind the OVV BALSAN ENCHERES.
